You and Retired but Active

You use the Retired but Active website (the "Website") subject to the terms of a this agreement between you and owners of Retired but Active made up of these terms of use, Retired but Active's Privacy Policy and the Retired but Active Editorial Code

The Terms apply to all users of and contributors to the Website

Accepting the Terms

By using the site you accept these terms.

Changes to the Terms

Retired but Active may change these Terms from time to time. When these changes are made,Retired but Active will post them on the site and by doing so will have given all the required notice of the changes and use of the site after the date of posting will constitute agreement and acceptance of the updated Terms.

User Accounts

To use the site’s facilities you will have registered as a user and chosen a password. It is your responsibility to protect this password and keep it confidential.

You must notify Retired but Active immediately of any breach of security or unauthorised use of your Retired but Active account that you become aware of.

You are responsible for all activity on your account.

Restrictions

Retired but Active permits you to use the Website, subject to the following conditions

you may not distribute any material from the site without Retired but Active's prior written authorisation;

you agree not to make alterations or changes to material or systems on the site, whether a user submission – other than your own – or part of the site structure or owner’s content.

you agree not to attempt to circumvent security related features of the Website or features that (i) prevent or restrict use or copying of any User Submissions or Retired but Active Content or (ii) enforce limitations on use of the Website or the content accessible on the Website;

You agree not to use the Website for any commercial purpose, without the prior written authorisation of Retired but Active.

You agree that you are solely responsible for (and that Retired but Active has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Retired but Active may suffer) of any such breach.

Our Content

With the exception of User Submissions, all other content on the Website is owned by Retired but Active, and is subject to copyright, trade mark rights, and other intellectual property rights of Retired but Active.

Retired but Active Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited without the prior written consent of Retired but Active

Links from Retired but Active

Users may not include links to other sites or services without the written approval of retired but Active who may terminate such links at any time and without notice.

Retired but Active has no responsibility for, the content or practices of any third party websites whether or not linked to Retired but Active. Where users use links from Retired but Active places links to other sites you acknowledge and agree that Retired but Active is not liable for any loss or damage which may be incurred by you as a result.

General legal terms

The Terms constitute the whole legal agreement between you and Retired but Active and govern your use of the Services and completely replace any prior agreements between you and Retired but Active in relation to the Services.

You agree tol comply with all provisions of the Terms and the Retired but Active site and community at all times during your use of the Services.

The Terms, and your relationship with Retired but Active under the Terms, shall be governed by English law. You and Retired but Active agree to submit to the exclusive jurisdiction of the courts of England to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Retired but Active shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.

Editorial Code

We'd like to think the world was full of decent, honest folk but...Retired but Active encourages all its members to contribute their own material to make the site vibrant and alive.
Unfortunately, whilst most of the world, and particularly the over-50 population, is honest and straightforward, a minority is not.

To allow for this we have to make and enforce a code of conduct on everyone. We all have to pay the price for our freedoms.

By submitting material to Retired but Active you accept that:

Retired but Active has the absolute right, in its sole discretion, to reject or remove any posting by you, or to deny you access to any part of the Retired but Active without prior notice or explanation, and without liability.

You indemnify Retired but Active, its owners, officers and other contributors, harmless from any loss, liability, claim, or demand, including reasonable legal fees, made by any third party due to or arising out of any Content that you post on Retired but Active causes Retired but Active to be liable to another.

You are solely responsible for the Content that you post on Retired but Active Sites and accept that Retired but Active has no responsibility to display, store or preserve your material.

You accept that placing material on Retired but Active you are putting it into the public domain where it may be copied and reproduced elsewhere. You herby indemnify Retired but Active from any claim by you or others in the event of theft.

Right to publish

Material posted on Retired but Active remains your property but by posting material to the Retired but Active Site you grant Retired but Active a limited license to use, modify, delete from, add to, and publicly display such Content solely on the Retired but Active Sites

After posting to Retired but Active you remain free to license your Content to anyone else in addition to Retired but Active, but Retired but Active is not required to pay you or a third party for the use of that material on Retired but Active sites.

Ownership

By posting material to Retired but Active you confirm that you own, or have the right to post, your Content on the Retired but Active Sites and that publication the Retired but Active Sites does not violate any applicable laws, and that you agree to pay for all royalties, fees, and any other monies owing to any person or entity by reason of any Content posted by you on.

Prohibitions

Material that

  1. solicits personal information from anyone under 18,
  2. is false or misleading, promotes illegal activities or conduct, is abusive, threatening, obscene, defamatory or libellous,
  3. is offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual,
  4. harasses another person or provides information that permits another to harass anyone,
  5. exploits people in any way, contains nudity or offensive subject matter or contains a link to an adult website,
  6. contains an unauthorized copy of another person's copyrighted work,
  7. or links designed to circumvent copy-protection devices, or provide pirated material of any kind or involves the transmission of junk mail or spam,
  8. in any way violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person,

Must never be posted to Retired but Active Sites.

Retired but Active’s Rights

Retired but Active may refuse to post or delete any content that might be offensive, illegal or violate the rights of any person, or harm or threaten the safety of any person.

Retired but Active reserves the right to investigate and take appropriate legal action against anyone who, in Retired but Active's sole discretion, violates this provision.

Commercial Content

The Retired but Active Site is for the personal use of Members and may not be used for promotional or commercial endeavours unless specifically endorsed or authorized by Retired but Active.

Commercial advertisements, affiliate links, and other unauthorized commercial material will be removed from the site without notice or explanation and may result in termination your Membership.
